Red Eagle Avionics, LLC: Terms and Conditions
To better serve our customers, the following Terms and Conditions apply to all new and existing quotes for maintenance and installation work to be performed by Red Eagle Avionics, LLC.No work will be performed on any customers’ aircraft unless the customer agrees to the following Terms and Conditions, and rightfully indicates so with a signature acceptance at the bottom of page 3.Red Eagle Avionics, LLC reserves the right to change and/or update the following Terms and Conditions at our discretion.Please read the following carefully and in its entirety:
1)This quotation supersedes any previous written or oral quotation from Red Eagle Avionics, LLC.No other work will be performed other than that detailed in this quote, unless approved by the customer.
2)This quotation is an invitation to engage in a legal and binding contract with Red Eagle Avionics, LLC to perform the work outlined in this quote.All customers are required to sign and date the Signature Acceptance line at the bottom of the applicable quote before a contract is initiated.
3)A 50% deposit is required for installations once the quote is signed and approved by the customer before any equipment can be ordered.The remaining balance is due upon delivery of the aircraft.Our available payment methods include: Check, Cash, and Credit Card (Visa, MasterCard, and American Express ONLY).
4)By having your maintenance or installations completed by Red Eagle Avionics, LLC, you will not pay any Sales Tax due to the fact that our business is located in the state of Delaware, a tax-free state.
5)Our shop work schedule changes weekly.Any shop dates in this quote must be confirmed to hold that work slot.Any dates quoted above are estimated dates only. These dates and times will vary based upon our ever-changing workload.Proposed job start dates should be verified at least one week prior to aircraft drop off.
6)This quotation is valid for (30) thirty days from the date listed at the top-right corner of the quote.
7)When you leave your aircraft at Red Eagle Avionics, LLC for work, it may be hangared or tied down outside at our discretion.
8)When you leave your aircraft for avionics work, please have your weight and balance data available to be modified if necessary.Red Eagle Avionics, LLC will generate stickers to place in your aircraft logs when work is completed.
9)Some vendors charge a variable re-stocking fee if the customer orders a part and decides to decline the use of the part.Any re-stocking fees for parts returned to the vendor will be passed on to the customer for payment.
10)When work is complete, customer will make arrangements to pick up aircraft before 3:00 p.m. Monday –Friday.We are closed on Saturday and Sunday.
11)Red Eagle Avionics, LLC will observe a test flight and certify the new installation, if applicable, prior to releasing the aircraft back to the customer.When scheduling allows, a qualified representative of Red Eagle Avionics, LLC may be available to fly with the customer on his or her initial flight to explain how the newly installed equipment works while airborne.This must not be expected as normal practice.
12)The cost of labor listed on the quote is an estimate only.Red Eagle Avionics, LLC and its employees must allow for situations beyond their control to occur during the installation process.Therefore, the estimated labor may be calculated at a higher rate to provide the technician sufficient time to overcome any worst-case scenario.Once the aircraft is delivered, the customer will be invoiced for actual labor hours.
13)All equipment removed from a customers aircraft becomes the property of Red Eagle Avionics, LLC if it is not reinstalled prior to customer aircraft deliver.All quote prices are based upon this standard policy.If the customer wishes to keep their replaced equipment, they must inform Red Eagle Avionics, LLC of this prior to signing a quote and entering a contract to have work performed.Under these circumstances, the quote price will be adjusted to counter the loss Red Eagle Avionics, LLC will incur from not retaining the replaced equipment.
14)GPS Databases: GPS and MFD units will have electronic databases included.Most of these databases run on a 28-day cycle, and therefore may be close to expiration (or expired) when the aircraft is delivered to the customer.This is due to 1) where in the database cycle the shipping occurs, 2) the elapsed shipping time of the unit from the manufacturer to Red Eagle Avionics, LLC, 3) and then the actual installation time itself at Red Eagle Avionics, LLC.If this creates a problem for the customer, we recommend that the customer contacts Jeppesen and order a database subscription services prior to taking delivery of the aircraft.Jeppesen can be reached at 800-621-5377 or on the Web at www.jeppesen.com.
15)Limited Warranty: Terms and Limitations: The factory new equipment being installed is warranted by the manufacturer.Used equipment, verified serviceable by Red Eagle Avionics, LLC, will carry a 90 day limited warranty, and may only be replaced with another used and serviceable unit when in stock.If a used and serviceable replacement unit is not in stock, the customer is responsible for the full purchase price of a manufacturer new equipment unit.Customer-provided equipment will have no warranty coverage.Any warranty issues or failure to perform issues relating to the factory new equipment installed on this quote will be subject to the terms and limitations of the manufacturer’s warranty covering that equipment and the manufacturer’s warranty shall be the sole and exclusive remedy for any breech of warranty or failure to perform.The parts and labor provided by Red Eagle Avionics, LLC (other than the factory new equipment covered by the manufacturer’s warranty) detailed in this quote will be covered by a Limited Lifetime Warranty from Red Eagle Avionics, LLC, for as long as you own the aircraft.Red Eagle Avionics, LLC will determine the scope of that limited warranty.Any manufacturer-authorized dealer at any manufacturer-authorized avionics shop, in accordance with the equipment manufacturer’s warranty policy, can perform warranty work to the factory new equipment.Any warranty work not covered by the new equipment manufacturer must be performed at Red Eagle Avionics, LLC.Red Eagle Avionics, LLC shall not be held liable for expenses involved in relocating the aircraft to the location where the warranty work will be performed.The warranty coverage described here shall be the sole and exclusive remedy for any failure of the work detailed in this quote, or related to the work detailed in this quote, to perform as advertised or expected.The foregoing limited warranties are given and accepted in strict liability, tort, or otherwise.Any litigation brought as a consequence of, or related to the services provided by Red Eagle Avionics, LLC shall be brought in a court located in New Castle County in the state of Delaware, and the customer agrees to be subject to personal jurisdiction in that court.If you have any questions on the scope of warranty, please contact the new equipment manufacturer, or Red Eagle Avionics, LLC.
* Any deviation to the above-listed Terms and Conditions must be approved by Red Eagle Avionics, LLC prior to entering a legal and binding contract.
